You can start LLC or 'C' corp on EAD. No consequences. You cannot start 'S' corp on EAD. See this:

What is interesting in this? This is not interesting, this is published guideline from USCIS. But the outcome is not guaranteed to get an EAD.

thank you so much for the reassurance, have been getting mixed reports of immigration officers denying re-entry, so am a little perturbed :) dont want to be stuck in a situation where i cannot re-enter :)

Here is my current visa situation
Labor, I-140 approved

I-485 pending for 3 years.
EB2/India � July 2007 filer
I got laid off last year and have been unemployed for 1 year.
I am thinking of applying for California state unemployment benefits. Here are my questions
1) Is there a risk that the EDD office could forward this information to USCIS
2) If the USCIS comes to know about this then is there a risk that they may issue a RFE for an updated job offer and subsequently deny I-485.

I have an opportunity to do some consulting work for a company B on a part-time basis apart from my current full time job with company A. I know that I will need another H1 for the part time gig but what I am confused about is whether the company B has to wait for next years quota to file for an H1 or can it file immediately ? Meaning is the H1b quota tied to max no of individuals ? or to max no of positions ?
I would appreciate if some one knowledgeable about the issue can comment on my question:confused:

My self and my wife both are on H1B. Both are working for different companies.
I filled I 485, EAD and AP through my company, for my self and my wife.
Questions:
1) I am the primary person. After getting the EAD, Is it possible, If my wife can open a consulting company with her name?
2) After opening a consulting company on her name, Is it possible, she can leave her H1B employer and run her own paystubs on her own company.

Should you get immunizations done *before* you met the Dr?
If you have immunization records, you need to present to the Doctor. If you do not have records, Doctor will administer certain vaccines or will request blood work to test for the immunity against certain diseases such as Vericella, MMR, etc.

Wondering if we need to Pay $80 towards Biometric Fee when Renewing I-131? paid the Biometric Fee last year when Applied for the First Time.
I did not pay any biometric fee for my AP renewal. My application is pending with TSC since May 30th.

Here is an excerpt from the link below.. it sounds crazy
"Visa numbers can retrogress in the middle of a month and become unavailable without prior notice. If there is a mid-month retrogression, USCIS could elect to stop accepting adjustment applications. While this is unlikely to occur in July 2007, it becomes more and more possible as the fiscal year progresses. "
I hope this doesnt happen.

Could Fragomen be simply saying that it is unlikely that the visa bulletin published in the middle of the month of July will have the dates retrogressed, but later mid-month bulletins (in Aug etc.) could bring news of retrogresssion?
Note that the first sentence of the paragraph from which "averagedesi" has quoted says that "Though the principal employment-based categories are current for July, future retrogression is possible ...." This seems to indicate that they will remain current throughout July, which is what we know/believe.

My wife got EAD card while she was on H-4 (I am on h-1). She used it for few months. She got RFE for 485 for visascreen (for nurses). It looks like she will not be able to produce the visascreen certificate within the RFE date and after grace period (33 days after denial notice of RFE).
Now when she gets the denial notice for I-485, subsequently, the EAD status becomes invalid. in this case, what will be the staus?
H-4 or no staus?
Upon the denial, do i need to reapply for H-4 status or she gets the h-4 status automatically since she has H-4 and EAD evan though she used EAD in the past.
Currently on passport, the H-4 status expires on Feb 08.

I will be remoting in from a different state. My employer would not file a new labor condition application which is required.
If the employer is the same and working remotely is an option, then why move from H1B to EAD. Why not keep the current status (full time) and work remote?

A friend of mine just told me that USCIS has issued "guidance" a couple of weeks ago that allows using the EAD and at the same time "preserving" the alien's H1B status.
I can't find the document, but he swears that he read it..
Not true. There was a request from AILA to USCIS regarding this issue for maintaining H-1 with full time employer and to work on EAD for part time work. USCIS does not not permit that at this time.

Hi people here,
I need your help.
My company, a consulting firm, received an intent to deny notice for my labor application. (They received it in 1st week of may and a** telling me now. Needs to be replied by Jun 1st)
The lawyer and HR tell me that I have to get letters from my managers at my different clients explaining why they needed BS + 5 years of experience for the position and why they need certain set of skills.
If anybody has experience in dealing with such notice, please give me your inputs. How do you justify a need of 5 years experience in tangible and intangible terms?

The withdrawal of the H-1B is not really what decides whether you are out of status. Presumably the former employer withdrew because you no longer work there. In that case, you have been out of status since you came off payroll.
However, if there is only a short gap between your last paystub and when the new company files the H-1B, you could still be approved for a change of employer and extension. You should discuss with the lawyer preparing the new H-1B.
You should not be subject to the cap in any case, since you were already counted towards the cap within the past 6 years.

Sent applications to NSC on 6/29 but receipted by CSC on 8/28. Later it was transfered to NSC back. No FP notice yet. But 2 LUDs on I-485, 9/19 and 9/20. EAD and AP are approved from CSC.

My Indian passport is going to expire very soon and my visa has also expired.
I have applied for extension for 3 years.
Will I face any problems in getting new passport from Indian Embassy?
Has anybody done that before?

you can get your passport renewed by sending it to the Indian Embassy in the US immediately. I don't know about your visa. Talk to your lawyer. But why did you let your visa expire? That I am sure you know IS ILLEGAL.
